1. What you are buying
A takeover buys your product the sole advertising position on a specific publisher's Fame page, starting when your payment is confirmed and ending when another advertiser pays more than you did. You are buying a position, not a period of time.
Displacement
When someone outbids you, your product is removed from the page immediately and moved to the public Fame History, where it remains visible with the amount you paid and how long you held the position. We will email you when this happens. You may take the position back at the new price at any time.
Overbidding
You may pay more than the listed minimum. Doing so raises the floor for the next advertiser, because the next price is calculated from what you actually paid. Amounts paid above the minimum are not refundable and confer no additional rights beyond the higher floor.
2. Payment
Charges
Payments are processed by Stripe. FameSpot never receives or stores your card details. Each takeover is a single charge — there is no subscription, no recurring billing and no automatic renewal.
When the charge takes effect
Your position becomes active only after Stripe confirms the payment. If the payment fails, is declined, or the checkout expires, no position is granted and no charge is made. If you are charged but the position cannot be granted for any reason, we will refund you in full.
Refunds
Takeovers are generally non-refundable, because the position is granted immediately and the publisher's share is transferred at the moment of payment. We will refund you where:
- the position was never granted despite a successful charge;
- the publisher's page was suspended or removed by us while you held the position;
- you were charged more than once for the same takeover; or
- we are required to refund you by law.
Where a refund is issued, the publisher's share is reversed alongside our own.
Taxes
Amounts shown exclude any taxes that may apply in your jurisdiction. You are responsible for determining and paying any taxes arising from your use of the service.
3. Your product and content
You are solely responsible for the product you promote, the destination it links to, and everything a visitor encounters after clicking through.
You must not promote
- malware, or anything that installs software without consent;
- phishing pages, or anything that harvests credentials;
- scams, fraudulent offers, or products that do not exist;
- adult content, or links to it;
- content that is illegal in your jurisdiction, the publisher's, or ours;
- impersonation of a person or company you do not represent; or
- another party's trademarks, branding or name without permission.
Review and suspension
New products are reviewed before approval. Materially changing an approved product's name or destination URL returns it for review. We may suspend a product or account at any time if we believe it breaches this agreement, and doing so removes it from every position it holds.
Publisher objections
Publishers can report the advertiser occupying their page. A report does not automatically remove you, but we may remove a product where a publisher has a reasonable objection to it appearing on their domain.
4. Performance and reporting
We report impressions, clicks, click-through rate and holding time for each position. These figures are collected in good faith and deduplicated per visitor, but they are estimates. We do not guarantee any level of traffic, impressions, clicks or outcomes.
Publisher traffic estimates shown in the marketplace are supplied by publishers and are not independently verified by us. You should treat them as claims, not measurements.
5. Termination
You may stop using FameSpot at any time. Ending your account does not entitle you to a refund for a position you currently hold, and does not remove your entries from the public Fame History of pages you have held, which is a permanent record of the auction.
6. Liability
FameSpot provides the marketplace. We are not a party to the relationship between you and any publisher, and we do not warrant the quality, traffic or audience of any publisher site. To the fullest extent permitted by law, our total liability to you is limited to the amounts you paid us in the three months preceding the claim.
7. Changes
We may update this agreement. Material changes will be notified by email and require acceptance before you can take over further positions. The version you accepted is recorded against your account.
This agreement operates alongside our Terms of Service and Privacy Policy.
